In short, the bill aims to restrict the power of Waqf boards to manage its properties and provides for more government regulation. The bill proposes to make registration with the District Collector’s Office mandatory for any bill property, so that the property can be evaluated.
The proposed change to the Waqf Boards Act 1995 has led to a heated political debate. Here’s what’s happening in simple terms: –
What’s Being Changed: The Union government wants to update the rules for managing waqf properties, which are lands and assets donated for religious and charitable purposes by Muslims.
Opposition’s Concern: Critics say this change could take away control from the Muslim community over their own properties and religious activities. They believe it might also lead to losing land and assets.
Government’s Defense: The ruling NDA party argues that the changes are actually requested by the Muslim community itself, who want better management and transparency for these properties. In short, there’s a disagreement over whether the amendment is a way to help manage waqf properties better or if it unfairly takes away rights from the Muslim community.
What is a bill property?
A Waqf property is a type of asset—like land or buildings—that is dedicated to God for charitable reasons. This dedication is usually done through a legal document.
Here’s a simpler breakdown:
What is it? It’s a property given to charity in the name of God.
How old is it? This practice has been around for a very long time, even before written records.
What can it be used for? It can be used to benefit the public, like funding schools, mosques, or shelters. Alternatively, it can be set aside to benefit the descendants of the person who created the Waqf bill.
Can it be sold or given away? No, a Waqf bill property cannot be sold or transferred. It remains dedicated to its charitable purpose forever. In essence, Waqf bill properties are meant to support good causes and are kept in the name of God, benefiting the community or specific families over time.
The Act allows waqf to be formed by: (i) declaration, (ii) recognition based on long-term use (iii) endowment when the line of succession ends. The Collector of the area will determine ownership in case of uncertainty, and submit a report to the state government. If deemed a government property, he will update the revenue records. The Bill empowers the central government to make rules regarding: (i) registration, (ii) publication of accounts of bill, and (iii) publication of proceedings of waqf Boards.
